What are the legal pitfalls in fencing property?

I have a neighbor that is non communicado. He refuses to discuss the repair of our fence. I can't repair it from my side and don't dare go on his property. I have been asulted once by this hot head.
What is the legal way to handle a neighbor like this.


Answer:
Your best bet, first, is to make sure whose property this fence is on. From your brief description, "our" fence could mean anything. Unless you both bought it and/or your contract calls for something in particular, the fence probably belongs to either you or him and not both.

If he has been hostile and physically aggressive with you, you probably are better off spending some time and money on an attorney. An attorney can help you to determine whether you have any civil legal recourse against your neighbor, which would include the fence and yourself, and whether it is worth going after him. At the very least, maybe a letter from an attorney could resolve the matter. If you are worried about price, I can only state that the cost of an attorney is far less than what it may cost you down the road if your problems (as you describe them) persist and get worse.
